Pictarine, Inc. (hereafter “Pictarine”, “we”, “us” or “our”) respects its users’ privacy. This Privacy Policy explains how we collect and use personal information from you (hereafter “user”, “you”, “your”, “me”), and the choices you can make. This Policy applies to your use of our websites, mobile sites and applications (“Platforms”) that link to this Privacy Policy. This Privacy Policy also addresses information we collect from you when you contact or interact with our customer service, or when you respond to a survey.
Please read this Privacy Policy in its entirety before using our Platforms. By using our Platforms, creating an account, or making a purchase, you are providing your consent to the collection, use, and sharing of your personal information as described in this Privacy Policy. Please read this policy carefully. If you do not agree with its terms, you should not use our Platforms. For certain activities, such as marketing communications or accessing your photos, we will ask for your express consent. Your use of our Platforms is also subject to our Terms of Use.
Our Platforms may be linked on other websites or may contain links to third-party websites and services with which we have no affiliation. Our Privacy Policy only applies to our Platforms, and we are not responsible for the privacy practices, security standards, or content of other third-party websites and services, including any social media platform on which we may have accounts. Please look up the privacy policies of those sites before providing your personal information to them.
1. What personal information do we collect and how do we use it?
We collect various types of personal information when you use our Platforms; purchase any products or services from us; contact one of our customer service representatives, access emails we send you; or complete a survey. This information may be collected directly from you (for example, when you complete our forms or enter your information on our Platforms to make a purchase) or indirectly through your device or browser when you visit our Platforms.
The following describes what categories of personal information we may collect, how we collect that information from you, the business purposes for which we generally use such information, and which types of trusted third-party service providers we may share that information with:
- Account & Contact Data: For example, your first and last name, email address, mailing/billing address, phone number, username, password. To create and manage your account.To process and fulfill your orders.To communicate with you about your orders and provide customer service.
- User-Generated Content: For example, photos you upload, their metadata (time, location), projects you create and your communications with us. - Transactional Data: For example, your order history, information needed to complete your order. To process transactions and maintain a record of your purchases.To handle returns or customer service issues.
- Payment Data: For example, your credit card information (number, expiry, CVV). To process payments for your orders. (Note: This data is sent directly to our payment processor and is not stored on our servers).
- Device & Usage Data: For example, your IP address, device type, browser identifiers, cookies, Browse activity, non-specific geolocation. To ensure our Platforms function correctly.To detect and prevent fraud and security incidents.To analyze Platform performance and improve user experience.To provide targeted advertising for our services on other sites.
- Precise Geolocation Data: For example, your device’s precise GPS location. To offer location-specific features or services within our mobile app (only with your express, opt-in consent).
- Marketing Data : For example, your communication preferences and engagement with our marketing emails. To send you marketing materials, promotions, and surveys you have consented to receive.
- Inferences: For example, inferences about your preferences and characteristics (e.g., potential interest in baby albums or wedding books). To personalize your experience and show you more relevant products and content.

- Order Fulfillment Partners: Vendors who print and create the products you order.
- Shipping & Mailing Services: Courier services that deliver your orders.
- Payment Processors: Secure third parties that process your payment information.
- Platform & Data Services: Vendors who provide data hosting, security, and performance analytics.
- Customer Support Providers: Partners who help us manage customer service communications.
- Marketing & Advertising Partners: Services that help us manage our marketing communications and advertise our services on other websites (this does not include sharing your photos).
We, including our employees and agents, use your information to fulfill product orders, service your account, to offer suggestions for personalized products based on your content with your consent or in accordance with applicable law, to deliver marketing communications and promotional materials that you may be interested in, to contact you and provide customer service, to protect the security or integrity of our databases or websites, to detect and prevent fraud or illegal activity, to take precautions against liability, to detect and remediate violations of our Terms of Use or other misuse of our Platforms, for internal operational purposes, to develop and improve our products and services.
Automatic data collection. We, our service providers, and our business partners may automatically log information about you, your computer or mobile device, and your interaction over time with the Platforms, our communications and other online services such as data concerning your device, internet or electronic network activity information and non-specific geolocation information, IP address, cookies, website browsing and interaction activity, other device or browser identifiers. Precise geolocation data when you authorize our mobile application to access your device’s location.
We may also collect and analyze aggregated and/or anonymized information to produce statistical data to help us improve our provision of our services and manage user activity across our Platforms.
We may also have access to other information about you in certain other situations:
- Information you provide about others: The content you choose to upload to our Platforms, including your photos, may include personal information of others. Before you upload and/or share personal information of others through our service, please ensure that you have the consent of such persons to do so.
- Other information contained in your photos: When you upload your photos to our platforms or give us permission to access the photos stored on your device, your photo content may also include related image information such as the time and the place your photo was taken, tags and similar information stored by your image capture device. If you wish to restrict the transfer of image metadata in your individual photos, please adjust the settings on the device used to capture the image.
- Information regarding minors: Our Platforms are not intended for or directed at children under the age of 14. We do not knowingly collect personal information from children under 14. If you are a parent or guardian and believe your child has provided us with information without your consent, please contact us at [email protected] , and we will take steps to delete such information.
- Other sources: We may also obtain data that is publicly available or from third party sources, such as address verification services or third-party marketing database partners, to improve the accuracy of and add to what we know about our customers and prospective customers. We may combine this information with your personal information for the purposes described in this Privacy Policy. We also may collect information from other companies, organizations, or third-party partners. For example, we may receive information about you from a partner when we jointly offer services.
2. Does Pictarine use my photos in advertisements?
No, Pictarine does not use your photos in its advertisements. Photos you upload to our Platforms may be incorporated into product recommendations that appear on your Platform homepage or in communications we send to you, but these photos aren’t used in public advertising, and only you will receive customized product recommendations made using your photos. You may opt out of receiving such communications from us and change your contact preferences within your account at any time.
3. How do we use Cookies?
Our Platforms and emails use pixel tags, web beacons, and similar tracking technologies (collectively referred to as “Cookies”) that are created when you use our online services and are stored on your computer or mobile device, and which collect information about how you use our services.
For example, we and our service providers use cookies to track what web or mobile pages you have viewed – to administer our services, analyze trends, generate analytics, provide a better user experience, improve our products and services, detect and prevent fraud or security incidents.
Cookies help us offer features like recognizing your browser when you visit, storing the contents of your shopping cart until you are ready to check out, customizing your current and future visits, remembering your login and account settings, and providing you with information about products that interest you. We also use the information we collect to compile statistics about our visitors and their use of our Platforms to monitor site traffic, develop marketing programs, and improve our Platform design and content.
We use the information collected by our third-party service providers using cookies to analyze and track data, improve our services, determine the popularity of certain content, and better understand our users’ online activity. Our service providers may also show you advertisements for our products and services on other websites and may combine this information with other information those service providers have gathered about your visits to those other websites so that the advertisements you receive are more likely to be of interest to you.
Depending on your web browser (including some mobile web browsers), you may have the ability to accept or decline cookies or other mobile device identifiers. 4. How do we share your information with third parties?
We do not sell, license or share the personal information we collect with unaffiliated third parties for their marketing purposes. We may share personal information in the following situations:
- To third-party service providers who act on our behalf: for example, to help us operate our services, fulfill your product orders, deliver our advertisements, process payments, enhance and personalize your shopping experience with us, and to provide professional, marketing, security and information technology services. These service providers may receive your name and contact information, payment information, photos and other content you upload to our Platforms, information about purchases you’ve made, cookies and other device identifiers, IP address, and website browsing and interaction activity. We only allow service providers to use your information in connection with the specific service they provide on our behalf.
- To Pictarine’s partners, affiliates and subsidiaries: for purposes described in this Policy and for example to offer you joint products and services. If you decide to use such products or services, we will share certain information about you with our partners for use as needed to enable us to provide such service.
- To law enforcement: we may be required to disclose certain information to respond to a subpoena, warrant, court order or similar judicial process, to comply with provincial, federal or local laws, to protect the security or integrity of our databases or website, to take precautions against liability, in the event of a corporate reorganization or, to the extent required by law, to provide information to law enforcement agencies, or as otherwise permitted by law. If necessary, we may also share information with law enforcement without a subpoena, warrant, court order or similar judicial process or similar judicial process if we reasonably believe that doing so may help protect the personal safety of a user, a photo subject, or members of the public. We reserve the right to report to the appropriate law enforcement or government agencies any information that we believe may be evidence of criminal activity or violation of any applicable law.
- In the context of a corporate transaction: your information may be shared with and then transferred to another organization if, for example, we consider engaging or do engage in a corporate transaction such as a merger or sale through which we would transfer the ownership or operation of the Platforms to another organization, or if we liquidate our assets or if we engage in any other business transaction.
- In other situations: we may also use or share your information to protect our own rights and interests, such as to resolve disputes, enforce our terms of service, to protect the rights and interests of our customers from individuals or organizations that violate the law.
5. How can you exercise your privacy rights?
- Right to Access : You have the right to access your personal information held by us. We may require additional personal information from you for the purposes of verifying your identity and rights. There may be times when we are unable to fulfil your request – for example, if providing access to your personal information would reveal confidential commercial or proprietary information or personal information about someone else (and we cannot separate your data), if we are prohibited by law from disclosing the information, or if we have a legal obligation to retain certain data. - Right to Correction: If you would like to correct your personal information on our Platforms, you must demonstrate to us the inaccuracy or incompleteness of your personal information, we will then modify this personal information (this could include the correction, deletion, or addition of information). Where appropriate, the modified information will be transmitted to third parties having access to this information.
- Marketing communications opt-out : If you no longer want to receive marketing communications from us, you can unsubscribe by changing your marketing preferences in your account settings, by following the unsubscribe link in the email you received, or by contacting us at [email protected] . We reserve the right to send you certain communications relating to the services we provide, such as service announcements and administrative messages (for example, communications related to a pending order, an unresolved customer service issue, or a Privacy Policy update). We do not offer you the ability to opt-out of receiving those communications.
- Right to Withdraw Consent: Where our processing of your information is based on consent, you can change your mind at any time, subject to legal or contractual restrictions and reasonable notice. Upon receipt of any explicit and detailed withdrawal request at [email protected], we will inform you of the implications of such withdrawal (for instance, we may not be able to provide some or all our products or services).
- Right to Complain: You have the right to lodge a complaint regarding our data handling practices with the relevant privacy supervisory authority. In Canada, you can contact the Office of the Privacy Commissioner of Canada or your provincial privacy commissioner.
6. How does Pictarine keep your information secure?
Pictarine prioritizes the security of your personal information and employs industry-standard measures to safeguard it from unauthorized access, disclosure or alteration when transferring your information. While we strive to protect your data, we cannot guarantee that our information security safeguards will never be compromised. We are not responsible for any interception or interruption of any communications through the internet or for changes to or losses of data.
Users of our Platforms are responsible for maintaining the security of any password, user ID or other form of authentication involved in obtaining access to password protected areas of any of our Platforms. To protect you and your data, we may suspend your use of any of our services, without notice, pending an investigation, if any breach of security is suspected. Access to and use of password protected areas of any of our Platforms are restricted to authorized users only. Unauthorised access to such areas is prohibited and may lead to criminal prosecution.
We do not store your credit card number and when you enter information such as a credit card number on our web forms, the transmission of that information is secured through different means, such as the use of mutual transport layer security (mTLS) or tokens.
7. Pictarine's use of Automated Decision-Making and AI
To enhance your experience, we may use automated systems and artificial intelligence (AI) to help you enhance the technical aspects of your photos or to suggest personalized products. For example, our systems may identify faces to help you create visual compositions or collages based on images you provided or recognize a birthday in a project to suggest a reminder.
You have the right to be informed if a decision about you is made exclusively by an automated system. You also have the right to know the main factors that led to the decision and the right to have the decision reviewed by a person. 8. How long does Pictarine retain your information? What are your options?
We retain your personal information only for as long as necessary to fulfill the purposes for which it was collected, including to provide you with our services, to comply with our legal obligations (e.g., tax and accounting requirements), resolve disputes, and enforce our agreements. Content in an active account, such as your photos and projects, is retained as long as your account is active. If you request us to delete your information or close your account, some information may still be retained for a reasonable time for re-activation purposes in case you decide to return to the Platforms.
If you request us to delete your information or close your account, some of the information you shared through the Platforms may still be accessible by those with whom you shared it. For example, if you shared an image enhanced within the Platform through social media, this image may still be visible by those with whom you shared it, even if we delete it from your account.
9. How does Pictarine make changes to this Privacy Policy?
We may amend the Privacy Policy from time to time in response to technical or technological enhancements to our Platforms which may affect the information we collect and the way we use it, or in response to changes in applicable laws or regulations. All changes will be incorporated into this Policy and posted on this page. The date of last revision to the Privacy Policy is indicated at the bottom of this page. If we change this Privacy Policy in a material way, we will endeavor to promptly notify our customers through a prominent Policy on our Platforms.

11. Transfers outside Canada
Our Platforms are hosted in the United States and some of Pictarine’s service providers are located outside of Canada, including in the United States. As a result, your personal information will be transferred, used, stored and/or accessed in countries outside of Canada, including the United States. However, all such information will be protected in accordance with this Privacy Policy. Please note that when your personal information is located outside of Canada it will be subject to the laws of the country in which it is situated.
